What is a tobacco tax?
In its most general sense, if an item is a tobacco product, as defined by federal law, then it is taxable when it is imported or produced in the United States. The manufacturer or importer likely owes the federal government tax upon manufacturing or importing the tobacco into the country. Similarly, the first company to manufacture or import a tobacco product, as defined by state law, is required to pay wholesale tobacco tax to its respective state. All cigarettes and tobacco products sold in the United States are taxed. Many states asses their own tax rates for each type of tobacco product. Businesses engaged in the sale, distribution, or manufacturer of tobacco products must pay both state and federal taxes on these products.

Am I entitled to a refund?
